East Stroudsburg Man Wanted on Bench Warrant After Months-Long Crime Spree at Local Stores; Also Faces Robbery Charges in Philadelphia

David Jacell Rosario missed December court date on criminal trespass charge; court records reveal pattern of theft, disorderly conduct at Dollar Tree and Giant; separately charged with robbery in Philadelphia where bail was revoked and reinstated

EAST STROUDSBURG, MONROE COUNTY — A 28-year-old Stroudsburg man is wanted on a bench warrant after failing to appear for his December court hearing on a criminal trespass charge—the latest case in a months-long pattern of theft, disorderly conduct, and confrontations at East Stroudsburg retail stores that landed him in Monroe County Prison over the summer.

David Jacell Rosario is also facing robbery and assault charges in Philadelphia stemming from an October arrest, where court records show his bail was revoked after he failed to appear, then reinstated when he showed up at a bench warrant hearing.

The bench warrant was issued December 16, 2025 by Magisterial District Judge Michael A. Wolbert after Rosario failed to appear for his preliminary hearing on a third-degree misdemeanor charge of criminal trespass—defiant trespasser. The hearing had already been continued three times.

Anyone with information on Rosario’s whereabouts is asked to contact Stroud Area Regional Police.

Pattern Emerges at East Stroudsburg Stores

Court records reviewed by the Pocono Review reveal a pattern of incidents at East Stroudsburg retail locations beginning in May 2025 and escalating through August.

On May 11, Officer Michael Chica cited Rosario for retail theft. In early August, Officer Shawn P. Downey filed multiple citations against Rosario—disorderly conduct, interfering with contents of a trash receptacle on August 7, and scattering rubbish on August 8.

According to the warrant narrative published by Stroud Area Regional Police, on August 8 at 5:15 p.m., officers were dispatched to the Dollar Tree on Lincoln Avenue for a disturbance. The assistant store manager told police Rosario had been “creating problems in the store recently” and stealing merchandise by pocketing items while paying for one or two things. When confronted, an argument ensued and Rosario made threatening comments.

Police recognized Rosario from previous interactions and located him on a bench outside the nearby Giant store. A records check revealed he had already been trespassed from the Giant.

Jailed in August, Pleaded Guilty in September

On August 26, Rosario was arrested by Officer Downey and charged with disorderly conduct as a third-degree misdemeanor. Judge Wolbert set bail at $5,000 monetary. Unable to post, Rosario was committed to Monroe County Prison.

Two weeks later, on September 9, Rosario appeared before Judge Wolbert and pleaded guilty to six charges in a single court appearance. All cases were closed with court costs adjusted to zero.

The criminal trespass charge—stemming from an August 25 incident at the Giant where he had been previously trespassed—was filed October 22 by Officer Wyatt A. Clements. Rosario was arraigned November 1 before MDJ Jamie Levy on $5,000 unsecured bail.

Robbery Charges in Philadelphia

While his Monroe County cases were proceeding, Rosario was arrested in Philadelphia on October 20 and charged with robbery, criminal attempt—theft, simple assault, and recklessly endangering another person.

Bail was initially set at $50,000 at 10 percent. On October 29, it was modified to $50,000 unsecured. But on November 4, Judge George R. Twardy revoked bail after Rosario failed to appear for his preliminary hearing.

On November 10, Rosario appeared at a bench warrant hearing. Judge David H. Conroy reinstated bail and changed it to ROR. A preliminary hearing was held December 2. The case remains active.

Court records show mail sent to Rosario was returned twice in late November.

Additional Pending Charges

Rosario has two additional pending summary cases in Monroe County before MDJ Kristina Anzini—dangerous burning from August 14 and disorderly conduct from August 23.
